The Difference Between Hemp and Marijuana

Same plant, different rules. Understanding the legal distinction that makes recreational hemp possible.

The Legal Definition

Under the 2018 Farm Bill, hemp is cannabis with less than 0.3% Delta-9 THC by dry weight. That's the only legal difference.

The Chemistry

Hemp and marijuana produce the same cannabinoids - THC, CBD, and hundreds more. The breeding determines the ratios:

  • Marijuana: Bred for high Delta-9 THC
  • Hemp: Bred for CBD, or other cannabinoids like THCA, Delta-8, THC-P

The Loophole That Matters

THCA (tetrahydrocannabinolic acid) is the precursor to THC. When heated, it converts to THC. Since THCA itself isn't Delta-9 THC, high-THCA hemp flower is federally legal - but functions like traditional cannabis when smoked.
